УГОВОР О ЗАБРАНИ НУКЛЕАРНОГ ОРУЖЈА – ПОЛОЖАЈ, ПРИМЕНА И ЗНАЧАЈ

Сажетак

Иако се сматрало да ће Уговор о забрани нуклеарног оружја представљати крај ере развоја ове врсте оружја и претњи нуклеарним ратом, то се није догодило. У раду се анализирају главни аспекти овог документа, његове предности и мане. Такође, упоредним методом покушаћемо да утврдимо однос овог уговора са осталим изворима међународног јавног права, пре свега уговорима који се могу односити на примену нуклеарног оружја, али и обичајима. Посебан осврт направићемо и на утицај Саветодавног мишљења Међународног суда правде о легалности употребе нуклеарног оружја на ставове држава о дозвољености употребе нуклеарног оружја. На самом крају, узимајући у обзир актуелне политичке и друштвене околности у међународним односима и мишљења теоретичара међународног јавног права, покушаћемо да одговоримо на питање зашто је овај уговор ипак важан, јер нуклеарно оружје јесте карта на коју играју нуклеарне силе, посебно у погледу потенцијалне употребе у случају самоодбране.
