ОБЛИЦИ ПРАВИЧНОГ ЗАДОВОЉЕЊА У ЕВРОПСКОМ СИСТЕМУ ЗАШТИТЕ ЉУДСКИХ ПРАВА

Сажетак

Европска конвенција о људским правима у чл. 41 овлашћује Суд да у случају њене повреде подносиоцу представке пружи правично задовољење чији је циљ да га стави у исти правни положај у коме би био да му права нису прекршена. Он то, најпре, може учинити путем декларативне изјаве да постоји повреда гарантованих права из Конвенције. Други облик правичног задовољења је надокнада материјалне штете, која се досуђује ради покрића стварне штете и измакле добити подносиоца представке. Оштећеној страни може бити додељена и накнада нематеријалне штете уколико је кршењем Конвенције повређен њен телесни или психички интегритет. Суд је, поред обештећења, досуђивао апликанту надокнаду трошкова поступка које је имао пред домаћим органима, као и трошкова насталих у поступку пред самим Судом. На основу Конвенције Суд је налагао државама и предузимање различитих индивидуалних мера ради успостављања статуса quo ante.
