NADNACIONALNA OBAVEŠTAJNA SLUŽBA NA POMOLU?
Sažetak
Rad analizira evoluciju i delovanje posebnih nadnacionalnih tela i organizacionih jedinica pri postojećim institucijama Evropske unije kojima je povereno obavljanje klasične obaveštajne i kriminalističko-obaveštajne funkcije. Autor analizu stavlja u teorijski okvir omeđen konceptima sekuritizacije javnih politika, demokratske kontrole obaveštajne funkcije i demokratskog legitimiteta, budući da je prenošenje metodologije obaveštajnog rada iz oblasti nacionalne bezbednosti u rad policije, carine, poreskih organa itd. otvorilo novi prostor u kojem može da dođe do narušavanja komunitarnih javnih interesa i ugrožavanja ljudskih i građanskih prava delovanjem nadnacionalnih institucija. Autor ukazuje na ozbiljnu pretnju koju pojačana i neselektivna sekuritizacija komunitarnih politika ima po krhku ravnotežu između doslednog poštovanja ljudskih prava i bezbednosnih obzira, o čemu svedoče i brojne kontroverze koje su se nedavno pojavile oko demokratske legitimnosti masovne primene obaveštajnih metoda i tehnika spram potencijalnog ugrožavanja prava na privatnost i drugih ljudskih i građanskih prava. Autor zaključuje da samo transparentna nadnacionalna obaveštajna služba smeštena u normativni i institucionalni okvir EU može da doprinese delotvornijoj zaštiti vitalnih bezbednosnih interesa, a bez podrivanja zaštite ljudskih prava kao jedne od temeljnih vrednosti evropske integracije.
