PRAVO NA IMOVINU U KONTEKSTU LJUDSKIH PRAVA SA POSEBNIM OSVRTOM NA PRAKSU EVROPSKOG SUDA ZA LJUDSKA PRAVA

Sažetak

Član 1 Protokola 1 Evropske konvencije o ljudskim pravima štiti fundamentalno pravo na mirno uživanje imovine. Ovo pravo podleže ograničenjima, čija se prihvatljivost procenjuje u svakom konkrenom slučaju na osnovu testa od šest pitanja koji je utvrdio Evropski sud za ljudska prava. Rad se bavi analizom slučajeva u kojima je Sud, primenom navedenog testa, utvrđivao povredu člana 1 Protokola 1 Evropske konvencije o ljudskim pravima. Metodom sinteze postojećih teorija iz oblasti zaštite prava na imovinu, deskriptivnim metodom i metodom analize sadržaja relevantne prakse Evropskog suda za ljudska prava došlo se do zaključka da je Evropski sud za ljudska prava, po pravilu, nalazio kršenje prava na imovinu ukoliko mere koje je država preduzela u konkretnom slučaju nisu bile u javnom ili opštem interesu, proporcionalne ili legalne.
