ПРАВНЕ ДИЛЕМЕ УПОТРЕБЕ ДРОНОВА У БОРБИ ПРОТИВ ТЕРОРИЗМА

Сажетак

У раду се разматрају правни аспекти употребе наоружаних дронова ради спровођења политике циљаног убијања у противтерористичким операцијама. Од терористичких напада 2001. године, политика употреба дронова ради спровођења циљаног убијања постала је централни део америчке противтерористичке стратегије. Међутим, употреба дронова у противтерористичким операцијама, са циљем извршења циљаних убистава, изазвала је бројне контроверзе и доспела у жижу интересовања јавности. С једне стране, апологете политике циљаног убијања путем наоружаних дронова сматрају да је у складу са правом на самоодбрану и адекватним резолуцијама Савета безбедности политика циљаног убијања легитимно средство борбе у рату против тероризма. Они истичу предности који проистичу из употребе дронова, наводећи како је реч о технологији која због хируршке прецизности смањује ризик од губитака живота недужних цивила. С друге стране, многобројни стручњаци, научници, новинари и невладине организације јавно су иступили против овакве политике, истичући да се употребом дронова крше неки од основних принципа права људских права и међународног хуманитарног права. У овом раду биће представљени аргументи за и против употребе наоружаних дронова, са акцентом на неке од најконтроверзнијих правних дилема, као што су циљано убијање и дистинкција.
