OBLICI PRAVIČNOG ZADOVOLJENJA U EVROPSKOM SISTEMU ZAŠTITE LJUDSKIH PRAVA

Sažetak

Evropska konvencija o ljudskim pravima u čl. 41 ovlašćuje Sud da u slučaju njene povrede podnosiocu predstavke pruži pravično zadovoljenje čiji je cilj da ga stavi u isti pravni položaj u kome bi bio da mu prava nisu prekršena. On to, najpre, može učiniti putem deklarativne izjave da postoji povreda garantovanih prava iz Konvencije. Drugi oblik pravičnog zadovoljenja je nadoknada materijalne štete, koja se dosuđuje radi pokrića stvarne štete i izmakle dobiti podnosioca predstavke. Oštećenoj strani može biti dodeljena i naknada nematerijalne štete ukoliko je kršenjem Konvencije povređen njen telesni ili psihički integritet. Sud je, pored obeštećenja, dosuđivao aplikantu nadoknadu troškova postupka koje je imao pred domaćim organima, kao i troškova nastalih u postupku pred samim Sudom. Na osnovu Konvencije Sud je nalagao državama i preduzimanje različitih individualnih mera radi uspostavljanja statusa quo ante.
