OBRAZOVANJE KAO FAKTOR OSNAŽIVANJA POSEBNO UGROŽENIH GRUPA STANOVNIŠTVA I ZAŠTITA OD DISKRIMINACIJE

ANALIZA ZAŠTITE OD DISKRIMINACIJE U KONTEKSTU LJUDSKIH PRAVA

Sažetak

Efikasna zaštita od diskriminacije je od izuzetnog značaja za uspostavljanje koherentnog i održivog sistema ljudskih prava. Donošenje Protokola 12 uz Evropsku konvenciju o ljudskim pravima je od izuzetnog značaja s obzirom da je uveo opštu zabranu diskriminacije. Nažalost, nakon skoro dve decenije od njegovog donošenja, diskriminacija i dalje predstavlja problem međunarodne zajednice. U radu su analizirani efekti opšte zabrane diskriminacije danas, sa posebnim fokusom na neke marginalizovane grupe. Problem je analiziran primenom konceptualne analize prava, analize sadržaja i sinteze. Rad ima za cilj da ukaže na činjenicu da su partikularističke tendencije, s obzirom da je zabrana diskriminacije danas opšteg karaktera, izlišne. Oportunije je, stoga, raditi na iznalaženju instrumenata za sveopšte promovisanje principa jednkosti među ljudima, ukazivanje na značaj tolerancije i, uopšte, prihvatanje različitosti.
